SC : "Workmen cannot be forced to work in different management."
While disposing CIVIL APPEAL NOs. 9921-9922 OF 2011, the Hon. Justice Mr. P. Sathasivam, of the Supreme Court of India, has recently observed in a precedent setting landmark judgment in respect of employees/workers of Phillips India Ltd., that " It is settled law that without consent, workmen cannot be forced to work under different management and in that event,
those workmen are entitled to retirement/retrenchment compensation in terms of the Act."
